Lawyer says case against MD is flawed

DUBAI // The lawyer for an Austrian doctor on trial over the death of a patient has accused the Dubai Health Authority (DHA) of filing an inaccurate and incompetent report on the matter.

The lawyer yesterday presented a legal translation outlining what she said were mistakes in the report, which formed the basis of charges, laid in July, of premeditated murder against the Austrian and one of his colleagues, the Indian doctor MA, who allegedly failed to resuscitate the patient.

According to prosecution records, EA, then the chief of the intensive cure unit at Rashid Hospital, issued orders to his staff on February 19, 2009, that Ghulan Mohammed, who was on life support, was not to be resuscitated if he suffered a heart attack. Mohammed had suffered from frequent heart problems.

Prosecutors allege that two days after issuing the non-resuscitation order, EA shut down the victim’s life support equipment and increased the morphine dose, resulting in a fatal heart attack.

In Dubai Criminal Court of First Instance yesterday, a doctor at the hospital denied that EA had ever issued a non-resuscitation order.

Another witness, the head nurse at the hospital’s trauma centre, also denied any knowledge of such an order.

The trial is to resume in January.
